SB 1146 -- ADMINISTRATIVE PROCEDURE AND REVIEW SPONSOR: Ridgeway (Pratt) COMMITTEE ACTION: Voted "do pass by consent" by the Committee on Judiciary by a vote of 11 to 0. This bill allows for the independent review of an agency's decision by an agency board other than the Administrative Hearing Commission. The aggrieved party may, within 30 days after the party receives notice of the agency's decision, waive the independent review by the agency board and file a petition in circuit court for the de novo review of the agency's decision. FISCAL NOTE: No impact on state funds in FY 2007, FY 2008, and FY 2009. PROPONENTS: Supporters say that the bill clarifies administrative procedures to give a litigant more options for reviewing adverse rulings by state agencies. The bill also revises the statutes to reflect the current practices of reviewing agency rulings. Testifying for the bill was Senator Ridgeway.
